DESCRIPTION
The American legal system and laws applicable to business emphasizing general contracts, sales contracts, agency contracts, intellectual property and the impact of the legal system on business, and ethical considerations in the business environment.

Eligibility for EWRT 1A; BUS 20 advised.

REQUIREMENTS
Be prepared to spend up to 12 hours per week in using and studying course materials (up to 24 hours per week in the summer).
1. Complete both the Distance Learning Online orientation and the Orientation in Catalyst. The Distance Learning orientation may be found at this address: http://distance.deanza.edu/
Pre-registered students who do not complete the online orientations by the deadline will be dropped to make room for students on the wait list.
2. View the ten hour long (approximate) "Business Law I" video programs, and two one-hour "Business Law Review Videos."
3. Complete all reading assignments.
4. Turn in the case analysis and the assigned chapter exercises from the Guide to Business Law.
5. Pass the midterm exam and comprehensive final exam.
6. Complete three Wall Street Journal news article summaries.

PLEASE NOTE THAT THE MIDTERM EXAM ON FRIDAY, OCT 30, MUST BE TAKEN ONLINE (BETWEEN 6PM AND 2AM) AT THE SCHEDULED TIME.

THE FINAL ON FRIDAY, DEC 4; 7:00-9:00 PM MUST BE TAKEN ON-CAMPUS AT THE SCHEDULED TIME in Forum 3.

** Wait Listed Students:

When enrolled students drop BEFORE final rosters are printed (Wednesday before classes begin), wait listed students automatically move into enrolled seats - an email is sent to the enrolled student letting them know of their "new" status and to pay their fees within five days if they want to officially maintain their enrolled status.

If the class is currently full and you are not on the Wait List, getting on the Wait List (through the registration process) will be the only chance of getting in. Again, once classes begin, no adds, even if on the Wait List if the class is full.

If the class is not full, then students will be given an add code on the Friday of the first week based on their spot on the wait list. Those wishing to add must e-mail the instructor after the first day of class and before 8AM on the first Friday of the term. I will e-mail add codes to the students who have e-mailed me and are the highest on the wait list based on the space available in the course.

OBJECTIVES
After completing the reading assignments and watching the video programs, you should:
1. Understand vocabulary, concepts and applications of the legal environment in which business operates, as it relates to general, contracts sales and agency relationships.
2. Be able to recognize legal problems.
3. Have a recognition of how to avoid legal problems and recognize when professional help is needed.
4. Understand some of your legal rights.
5. Improve your critical thinking skills by honing your ability to analyze a statement of fact(s), spot legal issues that arise out of these facts, and arrive at legal conclusions that are logical and coherent.

Viewing Options
  1. Watch at home during the cable TV broadcasts.
  2. Tape record your video programs during the telecasts and view them when convenient.
  3. View programs in the De Anza College Library West Computer Lab.
  4. Check out tapes from the Open Media Lab to view at home. SMART DASB Card required. The Smart Card Office is located on the lower level of the Hinson Center (408-864-5551).
  5. DLC ID Card required (available at the De Anza College Distance Learning Center, LC-107).
  6. One tape at a time may be checked out for 48 hours.
  7. Return tapes to Library West Computer Lab or in the drop box outside of Learning Center West (please report any videotape technical problems).
  8. Late fines: $2.00/day (maximum fine-$25.00); replacement/lost tape charge: $50.00/tape.

    STUDY EACH WEEK'S ASSIGNMENTS
    Work on the lessons in the following order: a. Review the lesson assignments in the Study Guide.
    b. Read the textbook assignments (as listed on the assignment schedule on this page).
    c. View the assigned videotapes.
    d. Complete assigned chapter exercises and post them in Catalyst.
    e. Complete the legal news article assignment from the Wall Street Journal and post it in Catalyst.
    f. Complete the Case that will be posted in Catalyst and turn it into the Distance Learning Center by the assigned date.

    All written homework except for the Case will be done in Catalyst. The Case is to be turned in at the Distance Learning Center, room LC-107. During regular hours drop them into the Homework Drop Box inside the office and sign in your name on the "Student Coursework Sign-In-Sheet" so there is a record of your paper being turned in there. After hours, drop them into the Homework Drop Box located by the Distance Learning Center back door (facing the California History Center). Please attach a cover sheet with your name, Business 18 homework, Michael Gough, Instructor, and the homework you are turning in: Example: Jane Doe, Bus 18, Michael Gough, Case homework your telephone number (should someone at the DLC need to contact you).

    Legal news articles from the Wall Street Journal: During three selected weeks of the quarter, you must select one major article from that weeks Journals regarding legal and business matters and write a summary of the article and explain how it affects business from a legal perspective. The format is:

    The summary should be approximately one page in length, single spaced, 12 point font.
    All Wall Street Journal assignments must be typed and will be submitted in Catalyst.

    Chapter Questions:
    Every few weeks you will turn in assigned "Chapter Questions" that appear in your Guide to Business Law Workbook at the end of each chapter and the questions will be posted in Catalyst. See the Assignment Schedule for specific chapter assignments and due dates. The questions are also posted on this website under Updates for Bus/Para 18

    Web Discussions:
    Three times during the term you will need to go to this website, click on Recent Discussion, then click on the discussion for Bus 18 Distance Learning. There will be a question posted that you must respond to and post (that all in the class will be able to read). Then you must respond to at least one other student as part of the exercise. You can look at discussions by other classes on this website for an idea as to how this works.

    Key Terms: (Extra Credit):
    Five points extra credit is available with each exam if you turn in the definitions of the key terms at the end of the Guide for each chapter you are tested on. For example, when you take test one; fax to the DLC or turn in the definitions to the key terms at the back of the Guide from chapters 1-7 (the chapters you are being tested on). You may write in the definitions. Do the same for the final. Make a copy because they will not be returned.

    Homework Case Analysis:
    During the quarter you will write one case analysis. The case will be posted on this website during the 8th week of the term (4th week in summer). Follow the case method below in formatting your work.

    Case Method: The case method will be used throughout the course: Facts (pertinent to law). As you read the case, you need to look at each fact presented and determine if it is important to the case and whether it has a consequence that needs to be evaluated as related to law.

    Issues: (problems within case which raise issue of law questions). After you have determined which facts are relevant, you must then determine what legal issue(s) are involved in this particular case. Issues are the problems that you must solve by the use of law.

    Holdings: (answers to issue relevant to the law). Since most of the cases used in this course deal with civil matters, your holdings will be for either the plaintiff or defendant. You need to identify who is the defendant and who is the plaintiff in each case. If the case involves more than two parties, you must associate each party with the appropriate plaintiff or defendant.

    Reasons: (facts of case which support your holdings and the law applied to these facts). This is the most important step. This is the justification of your holdings. You need to support your holdings with all the legal arguments as related to the facts and issues you presented.

    REVIEW MATERIAL FOR EXAMS
    View the Review Session on television, tape or webstream.
    The instructor reviews key concepts and homework problems that are critical in understanding the course objectives and helps you prepare for the examinations. Past experience has shown that students who follow these sessions closely have a better grasp of the course material and score higher on their exams.

    Copies of these sessions will be available at the Open Media Lab for your use there, or for overnight checkout. The reviews will also be available in the videostream format.
    Since new information regarding schedule changes or other problems may be announced during these review sessions, students who do not view the videotapes may miss essential information.

    TESTING AND GRADING
    EXAM#1, the midterm, WILL BE GIVEN ONLINE IN CATALYST Go to the Catalyst website: https://catalyst.deanza.edu/ and bookmark this page so you will be ready to login for exams. The exam time and instructions for logging in to Catalyst are on this web page. The exams will be composed of multiple choice questions and essay.

    REQUIRED: FOR THE ON-CAMPUS FINAL BRING A SCANTRON FOR THE MULTIPLE CHOICE PORTION AND BLANK PAPER FOR THE ESSAY PORTION OF THE EXAM. You may bring one page of notes (front and back) to the exam as a study sheet at the final

    Exam #1: ONLINE: Friday Oct 30; 6:00 PM to Saturday, Oct 31; 2:00 AM (note - the exam must be started by 11:55 PM on Friday in order to have the full two hours to take it) - go to the Catalyst server for this course and log in. The exam will open at 6 PM and close at midnight, you will have two hours to take the exam. It is multiple choice.
    (Exam #1 Covers text chapters 1-10; Guide chapters 1-8)

    Exam #2 (Final) ON CAMPUS: Friday, December 4; 7:00-9:00 PM in Room Forum 3. PLEASE NOTE THE FINAL IS ON CAMPUS AND MUST BE TAKEN AT THE SCHEDULED TIME.
    (Exam #2 Comprehensive with emphasis on chapters not covered in first exam - it is multiple choice and essay. You are allowed one page of notes, regular sized paper, front and back, at the exam.)

    Testing Materials: Bring one #2 pencil, a Scantron (the small half sheet), blank paper and a photo I.D. to the final exam.
    INSTRUCTIONAL TESTING Exam Scores: Exam scores are posted on the Catalyst website by De Anza student ID # approximately one week after each exam. You may review the exam online after the exam is closed on Catalyst. You can review the final exam in the DLC the first two weeks into the new term, but cannot take a copy of the test. Please show your DASB Smart Card to the Distance Learning Center staff.

    Grading Policies:
    If you sign up for the course and complete the orientation you are enrolled. If you do not complete the orientation you are dropped as a no-show. If you do not take the midterm examination you will be dropped with a W grade.


    Once you have indicated your enrollment in the class, it is your responsibility to monitor your enrollment and drop yourself if you believe you cannot pass the class. Other than failing to take the first midterm exam, it is entirely the student's responsibility to drop himself or herself in accordance with college guidelines and dates.

    Incomplete grades are only available under the following conditions:
    The student has done all of the work in the course and cannot take the final exam because of an emergency (verifiable illness, family death, car accident etc). If the issue arises prior to the date for withdrawal, then the student will take a W. If it occurs after the withdrawal date and all work in the course has been completed and a verifiable emergency has taken place, then an incomplete grade can be given. Please note, these are exceedingly rare.
